The Jury Act 1977 (NSW) provisions preserving juror anonymity (ss 29, 37, 67A, 68) are valid and do not infringe s 80 of the Constitution. Accused persons in Commonwealth criminal trials in NSW have no right to be supplied with the names and occupations of potential jurors prior to jury selection. The provision of juror names and occupations is not an essential feature of trial by jury; the right of challenge is preserved by the accused's ability to observe jurors physically and to exercise both peremptory and cause challenges.
