Following the repeal of s 16G of the Crimes Act 1914 (Cth), sentences for federal drug importation offences should increase by approximately 50% compared to the pattern of sentences previously imposed (which reflected the one-third s 16G discount). For peripheral participants in MDMA importation involving approximately 6 kg of pure drug, the appropriate head sentence range before discounts is 13 to 16 years. A composite discount approach for plea and assistance is preferred over separate sequential discounts, which risk double-counting and distraction from the overall reduction in sentence.
