Where counts in an indictment arise from a connected series of events and the evidence relevant to one count is directly relevant to issues in another count (such as consent), a joint trial is appropriate and no specific jury direction on the use of evidence across counts is required where there is no real risk of impermissible reasoning. The Crown is entitled to lead evidence revealing uncharged criminal conduct where that evidence is relevant to a charged offence, and there is no limit on this right based solely on the absence of a charge in respect of that conduct.
