Where experienced trial counsel deliberately chose to contest a DNA case on the risk of contamination rather than the correct statistical interpretation of DNA profiles, leave under Rule 4 to raise the statistical error on appeal will be refused where the result was inevitable given the rarity of the DNA profile and other circumstantial evidence. Precision and accuracy of expression as to DNA profiles remain highly desirable.
