A sentence of six years imprisonment for ongoing supply of cocaine compared with three years periodic detention for a co-offender in the same drug supply enterprise cannot be justified where the distinction between the offenders' cases, while real, does not warrant such a marked difference. The leniency inherent in periodic detention is a relevant factor in assessing disparity. A 20% discount for plea of guilty and remorse is appropriate where the Crown case is strong.
