Section 73(b) of the Jury Act 1977 (NSW) is confined to errors in jury documents as documents (such as misspellings of names or addresses) and does not save non-compliance with mandatory jury selection processes, even where the non-compliance is innocent and involves documents. Where a person not duly selected and summoned for jury service on the relevant day is included on the jury, the trial is a nullity regardless of whether the error was innocent or deliberate.
