Where an offender provides assistance to authorities under s 23 of the Crimes (Sentencing Procedure) Act 1999 in relation to the murder of a family member, the discount for such assistance may be modest because a family member would be expected to assist without incentive. However, the murder and its aftermath, including the assumption of care of the victim's children and the psychological impact on the offender, are matters properly taken into account in sentencing and may justify a reduction in the non-parole period as part of a finding of special circumstances.
