When a good behaviour bond attached to a suspended sentence under s 12 of the Crimes (Sentencing Procedure) Act 1999 (NSW) is revoked, the sentence of imprisonment commences from the date of the revocation order, not from the original date of imposition. Section 47 does not apply to a suspended sentence until revocation. The right of appeal under s 99(5) does not apply to revocation of a s 12 bond, but an appeal against the original sentence remains available under s 5(1)(c) of the Criminal Appeal Act 1912 (NSW). Whether there is any right of appeal from the revocation order itself was left open.
