A starting point of approximately 3 years 4 months for supply of 198 grams of heroin at 40% purity by a persistent drug offender with two prior convictions for heroin supply is manifestly inadequate against a 15-year maximum. Drug addiction provides limited mitigation where the offender is of mature years and has deliberately resumed drug use after completing parole for similar offences. On re-sentencing following a successful Crown appeal, a total sentence of 6 years (non-parole period of 3 years 9 months) was imposed at the low end of the range.
