A sentencing judge is not constrained to adopt the same notional starting point as a co-offender's sentencing judge when sentencing on a different factual basis as to the degree of participation. Parity requires that the sentences not be disproportionate after proper allowance for differences in circumstances, but does not require identical starting points. Form 1 offences should be attached to a specific count rather than taken into account globally across all principal offences.
