Where a trial judge directs the jury on the extended concept of joint criminal enterprise (requiring contemplation of the offence as a possible incident of the agreed crime), the verdict must be assessed against that direction even if a straightforward joint criminal enterprise direction would have been more appropriate. The proviso will not save a conviction where the jury was never directed on the basis that could have supported the verdict.
