Stable spinal fractures requiring no particular medical treatment and for which appropriate care is available within the prison system do not satisfy either limb of the R v Smith test for ill-health as a mitigating factor in sentencing. The case confirms that the threshold for receiving fresh evidence on sentence appeal where counsel failed to adduce evidence requires the evidence to be of such significance that the sentencing judge may have regarded it as having a real bearing on the decision.
