An indictment may be amended on appeal under s 572(3) Criminal Code (Qld) to correct the description of the property obtained (from 'Keno wagers' to 'credit') where the trial was conducted on the basis of the amended allegation and the appellant cannot demonstrate the trial would have been differently conducted. The offence of dishonestly obtaining credit is committed when credit is obtained during a period of betting, regardless of whether the accused owes money at the end of the night's betting.
