Where an accused's defence at trial is that the complainant actually consented to intercourse and was an enthusiastic participant, the rejection of that evidence by the jury does not create an evidentiary basis for a s 24 honest and reasonable mistake direction. The question whether s 24 should be put to the jury must be considered in the light of all the evidence, not as though the accused had not given evidence merely because the jury rejected it.
