A sentencing court exercising power under s 20(1)(b) of the Crimes Act 1914 (Cth) may impose a recognisance period that exceeds the period of imprisonment to be served in the community, provided it does not exceed five years. Section 16F does not limit this power. General deterrence remains an important sentencing consideration for social security fraud even where the offender gained no personal financial benefit and acted at the instigation of another.
