Section 29A of the Criminal Law (Sentencing) Act 1988 (SA) endorses the existing practice of the Court of Criminal Appeal in giving sentencing guidance but does not authorise the Court to prescribe actual sentences or benchmark sentences for future cases. A sentencing guideline may indicate an appropriate range of penalties and identify relevant principles, but cannot dictate outcomes. For causing death by dangerous driving under s 19A, a sentence of imprisonment of the order of three years, not suspended, will often be appropriate, though this is not a benchmark and cases may warrant substantially heavier or lighter sentences depending on the circumstances.
