Development authorisations are to be construed objectively as unilateral documents, primarily by reference to their own terms and the plans expressly incorporated, with limited recourse to extrinsic correspondence. An inconsistency between a provisional building rules consent and a provisional development plan consent is an irregularity that cannot expand the scope of a development approval beyond what was authorised by the provisional development plan consent. A development that has not been assessed against the development plan under s 33(1)(a) cannot constitute an approved development regardless of whether provisional building rules consent has been granted.
