A mortgagee's contractual right to indemnity costs for 'enforcement expenses' extends to costs incurred in defending a mortgagor's application for relief under s 55A(3) of the Law of Property Act, because such an application is part of the enforcement procedures, not independent of them. The Consumer Credit Code does not render such clauses void but requires that expenses be reasonably incurred, assessed on the facts of each case. However, if the mortgagor succeeds, the court's wide discretionary powers under s 55A(3) may prevent the mortgagee from recovering enforcement expenses.
