Handwritten annotations on photocopies of a will that record proposed lifetime gifts and intended instructions to a solicitor do not constitute documents intended by the deceased to be his or her will for the purposes of s 9 of the Wills Act 1997 (Vic). The existence of plans to have a solicitor prepare a formal amendment is a significant factor against treating informal annotations as testamentary.
