Non-financial contributions as homemaker and de facto partner over a lengthy period are sufficient to found a constructive trust based on unconscionable retention of benefit, even without any direct financial contribution to property acquisition. The equitable interest is quantified by excising non-income source contributions (compensation payments, third-party funds) from the purchase price and treating the homemaker's contribution as equal to 50% of the income-funded balance. Rights under Part IV of the Administration and Probate Act 1958 (Vic) survive the death of the applicant but are limited to reimbursement of expenses that diminished the applicant's estate.
