Where co-offenders are convicted of different offences carrying different maximum penalties arising from the same drug trafficking enterprise, the difference in maximum penalties must be reflected in the disparity between sentences, even where the offender convicted of the lesser offence played a significant role. A sentencing judge who makes favourable findings as to an offender's prospects of rehabilitation and unlikelihood of re-offending must reflect those findings in the non-parole period.
