The failure to take exception to a judge's charge at trial remains a substantial impediment to raising complaints about the charge on appeal, and a party cannot argue on appeal a case materially different from that conducted at trial, particularly where the new case would have required different evidence or cross-examination. A jury verdict will not be set aside as perverse where there was a body of evidence capable of supporting the verdict, even if the weight of evidence appeared to favour the other party.
