An order extending time under s 85D of the Sentencing Act 1991 (Vic) for a compensation claim against a convicted person is not a suitable subject for interlocutory appeal, whether characterised as civil or criminal, because any error can be raised on appeal from the ultimate compensation order. The question whether such appeals lie on the civil side under s 17 of the Supreme Court Act 1986 or the criminal side under s 567 of the Crimes Act 1958 remains unresolved.
