In a circumstantial drug trafficking case, telephone intercepts showing guarded communications, surveillance evidence of movements and timing, and the absence of any evidence supporting an innocent hypothesis were sufficient to exclude a reasonable hypothesis consistent with innocence. The court left open the question whether R v Doherty's approach to the accused's silence in circumstantial cases is consistent with Dyers v The Queen and related High Court authority.
