A jury panel is not invalidly constituted merely because it does not include a member of the accused's ethnic group, provided it was assembled by random selection in compliance with the Juries Act. A medical letter indicating stress and suggesting monitoring, without reference to unfitness to plead, does not oblige a trial judge to conduct a fitness hearing under the Crimes (Mental Impairment and Unfitness to Be Tried) Act 1997 (Vic). The Crown's duty to call witnesses extends only to those whose evidence bears in some material respect upon the issues in the proceeding, not every person from whom a statement was taken.
