Where a will is prepared on the deceased's instructions but the deceased dies before seeing the document, the mere giving of instructions to a solicitor is insufficient to trigger the dispensing power under s 34 of the Wills Act 1970 (WA). There must be evidence apart from the document itself that the deceased adopted or authenticated the contents of the particular document sought to be admitted to probate. Evidence that the deceased expressed a general intention to change her will, even if the expressed intentions broadly correspond with the document's terms, does not establish that the deceased intended that specific document to constitute her will.
