Where a trial has been completed but judgment not yet delivered, the primary consideration on an application to re-open is the embarrassment or prejudice to the other side. Evidence of post-trial events (such as a capital raising) will not justify re-opening where the delay would cause substantial prejudice, even if the evidence is taken at its highest.
