The Court has no power under the Trustees Act 1962 (WA) or the Corporations Act 2001 (Cth) to order a trustee to pay trust funds to a third party creditor of the beneficiary, even where the beneficiary is an inactive foreign corporation. Section 92(1) of the Trustees Act 1962 (WA) contemplates the continuation of the trust following directions and does not authorise directions that would effectively terminate the trust to the detriment of the beneficiary. Sections 447A and 447D of the Corporations Act 2001 (Cth) do not extend to trust relationships with subsidiaries of the company in administration.
