Where legal practitioners have been directly involved in settlement negotiations that are subsequently disputed, and those practitioners would be required to give contentious evidence about whether a binding settlement was reached, the court will restrain them from continuing to act. This is particularly so where the party relying on the settlement depends entirely on the evidence of its legal advisers, as neither party was personally involved in the negotiations.
