Where a case is close to being ready for trial and dismissal would leave the plaintiff's claim statute-barred, the length of delay and inadequacy of explanation cannot be treated as decisive factors in the absence of serious prejudice to the defendant. A litigant should not be shut out from bringing litigation merely because delays were caused by cash flow difficulties; the court must analyse the actual effect of impecuniosity on the progress of the litigation.
