A finding of legitimate forensic purpose justifying the issue of a subpoena does not automatically entitle the issuing party to unrestricted inspection of the documents produced. The court must separately determine at the second stage of the Waind procedure whether and to what extent inspection should be permitted, particularly where confidential Family Court materials are involved. The confidentiality of Family Court materials should be given a relatively high value in evaluating claims for inspection.
