Sections 56 and 58 of the Young Offenders Act 1994 (WA) are to be read together, so that a compensation order may be made against a responsible adult having regard to that adult's means and ability to pay, even where the young offender has no means. The conduct of responsible adults, including any failure of parental supervision and control, is a relevant consideration in the exercise of the discretion. A refusal to make a compensation order constitutes a 'decision as to the jurisdiction of the Court' under s 41(2)(a) of the Children's Court of Western Australia Act 1988, giving rise to a right of appeal.
