Outstanding breach of parole days must be taken into account when applying the totality principle to cumulative sentences, and a sentencing court misinformed about such days will have its sentence corrected on appeal. A plea of guilty entered at the commencement of trial, where it saves no trial process, merits very little if any discount. Sentences of 7 to 9 years for a single instance of sexual penetration without consent involving violence remain within the common range.
