Publication of identical magazine content on the World Wide Web is not a separate publication from the physical magazine for defamation limitation purposes — it is simply a later publication of the same matter. The s 160 Evidence Act 1995 presumption regarding postal articles does not apply to bulk commercial postal delivery where there is no prepayment. A limitation defence in defamation is properly raised by way of defence and dealt with by summary judgment (Order 17), not by strike-out for failure to disclose a cause of action (Order 29). The question of whether web publication of materially different content would constitute a separate publication was expressly left open.
