The exclusion from the definition of 'injury' in s 4(1) of the SRC Act for disease, injury or aggravation suffered 'as a result of failure by the employee to obtain a promotion' applies where the failure to obtain a promotion materially contributed to the condition, even if there were other concurrent employment-related causes. There is no requirement that the failure to obtain promotion be the sole cause. However, events connected with the process of evaluating a promotion application are not necessarily bound up with the failure to obtain the promotion itself, and may in appropriate cases be treated as distinct causes.
