Country information consulted by the Tribunal after a hearing that merely confirms assessments already discussed with the applicant does not give rise to a denial of procedural fairness, even where the Tribunal has not put the updated information to the applicant. The settled construction of s 424A(3)(a) treats the reference to a class of persons as underlining the specificity requirement, not as a separate criterion. Full Courts should not be invited to depart from settled Full Court constructions of statutory provisions on the basis of mere repetition or development of previously rejected arguments.
