An environmental consultant engaged by a vendor to remediate and validate a contaminated site does not owe a duty of care in negligence to a subsequent purchaser who voluntarily entered into a contract of sale containing provisions for environmental certification, where the purchaser could have negotiated different terms or engaged its own consultant. A claim under s 52 of the Trade Practices Act based on representations in environmental reports requires proof that the claimant actually relied on the specific representations alleged, not merely that the reports were provided in the course of the transaction. The Court left open whether a duty of care for negligent misstatement might be owed by an environmental consultant to prospective purchasers in such circumstances.
