Where a head contractor delegates a specific construction task to a sub-contractor but itself provides and maintains the means of access (such as a ladder) for tradesmen to reach the work site, the head contractor retains the statutory duty under Regulation 73(2) of the Construction Safety Regulations 1950 to ensure that means of access is safe. The provision of such access is itself 'building work' that has not been delegated. The Maggiotto reconciliation of the majority and minority judgments in Buckman remains binding on the Court of Appeal notwithstanding Santow JA's misgivings in Bhambra.
