Where a party appears with separate legal representation as both plaintiff and defendant in cross-actions (including motor vehicle claims), the normal costs order is that a successful plaintiff receives only half costs and a successful defendant receives only half costs. Parties who consider dual representation necessary should seek leave of the court in advance; if leave is granted, full costs will generally be awarded. The court will exercise its costs discretion to create an incentive against unnecessary dual representation.
