Section 601AG of the Corporations Act 2001 (Cth) operates so that the insurer of a deregistered company stands in the shoes of the company: the insurer may raise the s 151D(2) time bar defence, but the claimant retains the right to apply for an extension of time against the insurer as if the insurer were the employer. The expiry of the s 151D(2) limitation period does not extinguish the underlying liability for the purposes of s 601AG(a), because s 151D(2) bars only the remedy, not the cause of action.
