On an application under s 60C of the Limitation Act 1969 (NSW), the applicant is not required to prove the elements of the cause of action (including causation) to the point of final persuasion. The applicant need only establish that there are reasonable prospects of success in establishing the cause of action at a final hearing. A judge who determines causation on a final basis on such an application commits reviewable error.
