An offer of compromise made under District Court Rules does not govern costs of the appeal in the Court of Appeal; costs of the appeal follow the event of the appeal. The possibility that the appellant may ultimately recover less than the offer or less than workers' compensation payments already received is not a sufficient reason to depart from the normal rule. Where a matter is remitted for a new trial, costs of the first trial should be left to the discretion of the judge on remitter.
