Where a party to a de facto relationship has made contributions to the conservation of property owned by the other party that saved the property from being sold, the court must consider whether it is just and equitable for the contributing party to share in the capital appreciation of that property proportionate to their contribution. A failure to consider this possibility constitutes appellable error. Separately, successful use of the offer procedure by a defendant gives rise only to a prima facie entitlement to party and party costs, not indemnity costs.
