Section 710 of the Local Government Act 1993 (NSW) is a code that provides for both the modes and time of service of council notices. Where a rates notice is posted by prepaid letter in accordance with s 710(2)(c), service is effected at the time of posting, not on the fourth working day after posting as would otherwise be the case under s 76(1)(b) of the Interpretation Act 1987 (NSW). The question of what constitutes 'evidence sufficient to raise doubt' under s 76(1)(b) — whether confined to non-receipt or extending to evidence of actual delivery — was left open.
