A pleading that alleges facts capable of constituting a breach of a development consent condition, on an arguable construction of that condition, discloses a reasonable cause of action even if the pleading does not clearly articulate the construction contended for. Failure to articulate the construction may justify striking out the pleading as embarrassing but does not justify summary dismissal for failure to disclose a cause of action. An error in finding no reasonable cause of action vitiates a discretionary decision to summarily dismiss proceedings.
