A payment claim under the Building and Construction Industry Security of Payment Act 1999 (NSW) that purports in a reasonable way to identify the construction work to which the progress payment relates satisfies s 13(2)(a) and cannot be treated as a nullity, even if the identification is not entirely successful in all respects. The identification requirement is an objective test: the construction work must be identified sufficiently to enable the respondent to understand the basis of the claim, taking into account the parties' background knowledge from past dealings. A respondent who considers the identification inadequate must serve a payment schedule raising that issue, rather than ignoring the claim and later resisting summary judgment under s 15.
