A statutory administrator of a building insurance scheme cannot revoke an approval of a claim after the claim has been determined by a tribunal and upheld on appeal, and the administrator has acted upon the determination. The administrator's power is spent and a purported second decision is ultra vires. Clause 10 finalisation of liability provisions cannot be relied upon where the administrator's own delays caused the effluxion of the limitation period. Defences available but not raised in earlier tribunal and court proceedings are precluded by Anshun estoppel.
