A starting point of 8 years imprisonment for importing more than four times the minimum commercial quantity of MDMA (2,025.9 grams pure) as a courier was held to reflect an overestimate of the appropriate reduction for the offender's depression and anxiety, resulting in a manifestly inadequate sentence. The mere existence of a causal link between mental disorder and offending does not inevitably lead to marked reduction in sentence; the degree of reduction must be proportionate to the assessed severity of the condition. On resentencing with Crown appeal restraint, a head sentence of 12 years reduced to 9 years for the early guilty plea was imposed.
