ADHD may in appropriate cases attract the principle that general deterrence is of lesser importance, depending on the severity of the condition and the presence of associated conditions such as Adjustment Disorder; R v Dunn is not authority for an absolute exclusion of ADHD from this principle. A mere statement that it is appropriate to depart from the standard non-parole period, without identifying the relevant factors, their weight, and their role in structuring the sentence, does not comply with s 54B(4). Deliberate bushfire offences in national parks by trained firefighters are in the upper range of objective seriousness and ordinarily require full-time custodial sentences.
