The standard non-parole period under Division 1A of the Crimes (Sentencing Procedure) Act 1999 is intended to apply to mid-range offences after trial. Where an offender pleads guilty, the standard non-parole period must be discounted accordingly. A finding of special circumstances under s 44(2) requires a reduction in the non-parole period to enlarge the period of eligibility for parole; it does not permit an extension of the head sentence beyond that properly applicable for the offence.
